Utah Bill on TICs Waits to be Signed Into Law

When Utah ended its 45-day 2005 state legislative session last Wednesday, among the bills waiting to be signed, vetoed or allowed to go into law without the signature of Gov. Jon Huntsman Jr. was SB 64, which essentially excludes tenant-in-common transactions from the state’s definition of securities and thus allows all TIC deals in the state to be sold strictly as real estate.
